Depending on how you use the Service, we may collect your name, username or display name, email address, telephone number, Account credentials, preferences, country or region, age-confirmation information, Account-verification information, and User Content. If you interact with Nopely for a Business, we may also collect the Business name and your name, email address, telephone number, role, authority, and information submitted to request or administer business access. We may collect information you voluntarily provide to substantiate a Review, submit a report or appeal, contact support, or otherwise communicate with Nopely.
B. Device, Usage, and Technical Information. We and service providers acting on our behalf may automatically collect IP address, browser and device type, operating system, device identifiers, language, approximate location derived from IP address, referring and exit pages, searches, pages viewed, clicks and interactions, session information, dates and times of access, crash data, security information, and diagnostic or performance data.
C. Location Information. You may provide a city, area, or other location when searching, adding a Business, or using other features. If you choose to use a device- or browser-based location feature, Nopely may receive more precise Location Information through your device or browser. Device-based location is collected only when you permit access. You can disable that access through your device or browser settings, although some location-based features may no longer function as intended.
D. Cookies and Similar Technologies. We may use cookies, pixels, local storage, software development kits, and similar technologies to operate and secure the Service, maintain sessions, remember preferences, authenticate Users, prevent fraud, understand usage, measure performance, and, where permitted, support analytics, advertising, or marketing. Where law requires prior consent for non-essential technologies, we will request it. See our Cookie Policy.
E. Information From Other Sources. We may receive Personal Information or other information from other Users, Businesses, public sources, business websites, publicly accessible social media, authentication, security or anti-fraud providers, analytics providers, service providers, and other lawful sources. This may include Business Profile information and information used to identify or prevent duplicate listings.
3. Public and Sensitive Information
Nopely is a public review platform. User Content you intentionally submit for public display may be visible worldwide, indexed by search engines, and copied, quoted, cached, archived, or shared by third parties. If you do not want information publicly available, do not include it in public User Content or a public profile.
Do not publicly post government identification numbers, payment card or financial account numbers, passwords, precise private home addresses, private medical records, biometric identifiers, another person’s precise location, or other unnecessary highly sensitive Personal Information. Precise Location Information may be considered sensitive Personal Information under some laws. Nopely does not publicly display your precise device location unless you intentionally choose to publish location information through the Service.
4. How We Use Personal Information
We may use Personal Information to:
- provide and operate the Service, maintain Accounts, publish User Content, display Reviews and ratings, and provide search, discovery, business-panel, analytics, and support features;
- provide location-based features, including nearby Businesses, localized results, and other functionality you request;
- create and administer Business Profiles, check for possible duplicate listings, verify authorized Business representatives, and support Business responses and analytics;
- verify Reviews, detect fake Accounts, fraud, bots, spam, impersonation, coordinated activity, manipulation, and other misuse;
- moderate content, investigate reports, protect Accounts, maintain security, and enforce the Terms of Use;
- communicate with you about support, security, moderation, privacy requests, policy changes, and other Service matters;
- analyze and improve features, search, rankings, performance, reliability, and user experience;
- comply with law, respond to lawful process, protect rights and safety, and establish, exercise, or defend legal claims; and
- where permitted, send marketing communications and conduct analytics, advertising, or measurement, subject to applicable consent and opt-out requirements.
5. Legal Bases for Processing
Where applicable law requires a lawful basis, including in the European Economic Area (“EEA”) and United Kingdom, Nopely relies as appropriate on performance of a contract, legitimate interests, consent, compliance with legal obligations, and other lawful bases recognized by law. Legitimate interests may include operating and improving Nopely, protecting review integrity, maintaining Business Profiles, preventing duplicate or fraudulent listings, detecting fraud and abuse, securing the Service, moderating content, understanding usage, protecting legal rights, and enforcing the Terms of Use. Where required, we balance those interests against individual rights. Consent may be withdrawn at any time, subject to applicable law, without affecting processing that was lawful before withdrawal.
6. How We Disclose Personal Information
We may disclose Personal Information:
- publicly, when you intentionally include it in public User Content;
- to service providers that support hosting, security, data storage, authentication, communications, customer support, analytics, fraud detection, content moderation, location-enabled features, professional services, or other operations;
- to analytics, measurement, or advertising providers where enabled and permitted by law;
- when reasonably necessary to comply with law or legal process, enforce our Terms of Use, investigate fraud or security incidents, address illegal content, protect rights or safety, or establish or defend legal claims; and
- in connection with a financing, restructuring, merger, acquisition, asset transfer, change in control, insolvency, or similar transaction, subject to applicable privacy requirements.
Service providers may receive Location Information only as reasonably necessary to provide, secure, support, or analyze the relevant Service features and subject to applicable contractual and legal requirements.
7. Sales, Sharing, Cookies, and Privacy Choices
Nopely does not sell Personal Information for monetary consideration. Some privacy laws define “sale,” “sharing,” or targeted advertising more broadly and may apply to certain advertising or analytics activities. If Nopely engages in processing that triggers an opt-out right, we will provide the legally required choice, which may appear through a Your Privacy Choices, Cookie Settings, or similar control.
Where applicable law requires recognition of a qualifying universal opt-out mechanism, Nopely will process supported signals, including Global Privacy Control (“GPC”), as required by law. You may also manage cookies through available Nopely controls and your browser settings. A generic “Do Not Track” setting is not treated as a privacy request unless applicable law requires otherwise.
8. Location Choices
You can enter a city or area without enabling precise device location. Approximate Location Information may be derived from an IP address when you use the Service. More precise device or browser location is received only when you enable or permit location access. We may use Location Information to show nearby Businesses, localize results, support location-related Reviews or Business Profiles, prevent fraud or abuse where permitted, or provide other features you request. You can withdraw device or browser permission at any time. Disabling precise location does not prevent Nopely from using a location you type or deriving an approximate location from information such as your IP address where permitted by law.
9. Retention and Security
We retain Personal Information only for as long as reasonably necessary to provide the Service, maintain Account, Business Profile, and Review-integrity records, prevent fraud and repeated abuse, maintain security, comply with law, resolve disputes, enforce agreements, and establish or defend legal claims. Retention periods vary based on the information and purpose. Deleted content or Accounts may remain temporarily in backups or be retained where legally permitted for security, fraud prevention, compliance, disputes, or claims.
Nopely uses reasonable administrative, technical, and organizational safeguards designed to protect Personal Information against unauthorized access, loss, misuse, alteration, destruction, or disclosure. No system can be guaranteed completely secure. If you believe your Account or Personal Information has been compromised, contact [email protected] or [email protected].
10. International Data Transfers
Nopely may be accessed globally, and Personal Information may be processed in countries other than where you live. Where law restricts international transfers, Nopely will use legally recognized safeguards as required, which may include adequacy decisions, the European Commission’s Standard Contractual Clauses, applicable United Kingdom transfer mechanisms, contractual and technical safeguards, consent where valid, or another lawful mechanism.
11. Your Privacy Rights
Depending on where you live and applicable law, you may have rights to access, correct, delete, restrict or object to certain processing, obtain certain information in portable form, withdraw consent, opt out of direct marketing, opt out of qualifying sales, sharing or targeted advertising, limit certain uses of sensitive Personal Information, object to certain profiling or automated decision-making, appeal certain privacy decisions, and complain to an appropriate privacy or data-protection authority.
To exercise a privacy right, contact [email protected] or use an available privacy-request or Privacy Choices tool. We may request information reasonably necessary to verify identity or authority. Requests may be limited or denied where an applicable exception applies, including to protect freedom of expression, prevent fraud, maintain security, protect others, comply with law, preserve evidence, or establish or defend legal claims. We will not unlawfully discriminate against you for exercising an applicable privacy right.
12. Regional Privacy Information
EEA, Switzerland, and United Kingdom. Where applicable European or UK data-protection law applies, you may have rights to access, correction, deletion, restriction, objection, portability, withdrawal of consent, safeguards concerning certain automated decisions, and complaint to a supervisory authority. Where required, you may also request information about legitimate interests and international-transfer safeguards. If applicable law requires Nopely to appoint or identify a data protection officer, representative, or other privacy contact, that information will be made available as required.
United States, Including California. Residents of certain U.S. states may have rights to access, correct, delete, obtain portable copies of Personal Information, opt out of qualifying sales, sharing or targeted advertising, limit certain uses of sensitive Personal Information, opt out of certain profiling, and appeal certain denied requests. California residents may also have rights under the California Consumer Privacy Act, as amended (“CCPA”). Categories of Personal Information Nopely may collect include identifiers, customer-record and business-contact information, internet or electronic-network activity, commercial or interaction information, approximate geolocation and, if enabled, precise geolocation, visual or audio information, professional information, User Content, and inferences associated with Service use or platform integrity. Precise geolocation may be sensitive Personal Information. Sources, uses, and recipient categories are described above. Nopely will recognize qualifying opt-out preference signals where required by law.
Other Jurisdictions. Where applicable laws in Canada, Brazil, Australia, New Zealand, Singapore, Japan, South Korea, Hong Kong, Taiwan, or other jurisdictions provide additional rights or requirements concerning notice, consent, access, correction, deletion, security, retention, cross-border transfers, complaints, or automated processing, Nopely will provide those rights and comply with those requirements to the extent applicable. This includes applicable rights under Brazil’s Lei Geral de Proteção de Dados Pessoais (“LGPD”) and other applicable privacy laws.
13. Automated Systems
Nopely may use automated systems, including AI-assisted tools, to help check for duplicate Business listings, detect fraud or spam, identify fake Reviews or Accounts, protect Account security, rank or recommend information, classify content, and prioritize moderation. Automated tools may identify information for review or assist with decisions, and human review may also be used. Where applicable law restricts decisions based solely on automated processing that produce legal or similarly significant effects, required safeguards will be provided.
14. Communications and Third-Party Services
You may unsubscribe from promotional emails using the unsubscribe mechanism in the communication or available Account preferences. Nopely may continue to send non-promotional communications concerning Accounts, security, support, privacy requests, moderation, legal matters, Service changes, or important policy notices.
The Service may link to or integrate with third-party services that collect Personal Information under their own policies. Nopely is not responsible for a third party’s privacy practices merely because the service is linked to or accessible through Nopely.
15. Children
Nopely is intended for adults. Users must be at least eighteen (18) years old, or the applicable age of legal majority if higher, to create an Account or submit User Content. Nopely does not knowingly collect Personal Information from children in violation of applicable law. If we learn that Personal Information was collected from a child in circumstances requiring action, we will take appropriate steps. A parent or guardian may contact [email protected].
16. Changes to This Privacy Policy
Nopely may update this Privacy Policy as the Service, technology, privacy practices, or legal requirements change. The “Last Updated” date identifies the current version. Where a material change requires additional notice or consent, Nopely will provide it as required by law.
